This website is operated by Art Springs. Throughout the site, the terms “we”, “us” and “our” refer to Art Springs. Art Springs offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

By enrolling your child (“Attendee”) in a class at Art Springs you, the legal parent or guardian of the Attendee (“you” or “your”), agree to the following terms and conditions:

Enrolment Terms and Conditions

Payment and Refunds
Payment is required to secure a place in the chosen course. Payment has to be made in advance on Art Springs website (https://artsprings.com.au).

A refund is only available if the enrolment is cancelled within 10 days notice prior to the holiday class or term classes commencing for cash payments. If a course is cancelled due to insufficient numbers, Attendees are notified and offered the choice of a refund or enrolment in an alternative course. No credit or refund is provided for missed classes. 

All online sessions are group sessions in accordance to NSW Guidelines.

No monies shall be exchanged in lieu of NSW Services Creative Kids Vouchers. Art Springs does not refund any monies against NSW Services Creative Kids Voucher. Once NSW Creative Kids Voucher is used at Art Springs, no refund will be made against booking cancellation or missed class or any in ability/failure to attend classes.

Behaviour and Attendance
Art Springs reserves the right to immediately and without notice terminate the enrolment if the Attendee is, in the view of the Art Springs, disruptive, or may harm themselves or others. Enrolment may also be terminated if an Attendee causes deliberate damage to the premises or equipment. No refund will be provided if your child is excluded from class due to their behavior.

Attendees are required to be dropped off and collected from the classroom door. As soon as the Attendee has left the classroom no responsibility is taken for the Attendee. It is your responsibility to ensure the Attendee arrives and leaves the class safely. Please be punctual. If you are running late please text or phone Vipula at 0469591639 at the finishing time of your child’s class.
If a class or classes are missed, Attendees are not entitled to a discount or ‘make-up’ class. However, an alternative time or location may be offered at the sole discretion of the Art Springs.

Safety
If emergency services (such as an ambulance) are called by the Art Springs or other person, for any reason, then you are responsible for all costs and indemnify and hold us harmless.
The Attendee must be appropriately attired and the Art Springs is not responsible for any damage or marking on the Attendee’s clothes. Shoes must be worn to attend class, thongs or bare feet are not acceptable.
It is a requirement that you notify the Art Springs if the Attendee has any medical or special needs. This includes specific learning or behavioural conditions or any existing medical conditions, allergies or disabilities whether they affect class participation or not.

Privacy
You authorise the Art Springs to send you emails for any purpose including enrolments and marketing. You are able to unsubscribe from such emails at any time.

Photography
Art Springs takes photographs of the Attendees and their artworks. These photographs are used for promotional purposes such as press advertising, brochures, editorials, on our Facebook page and on our website. You authorise the Art Springs to take and use these photographs for any purpose. You are able to withdraw your consent at any time in writing.

During unavoidable circumstances, Art Springs may cancel the Art Class (online or Studio class). Art Springs cannot be held liable under any circumstances for cancellation of art class. Attendee may choose to refund the money for cancelled art class by Art Springs (if monies have already been paid to Art Springs).

• Art Springs will confirm classes after redeeming Creative Kids Voucher from NSW Services website
• Art Springs will not exchange or return any monies in lieu of Creative Kids Voucher
• Art Springs does not refund anything against Creative Kids vouchers. Once the voucher is redeemed by Art Springs, we do not refund
• All materials supplied by Art Springs have been manufactured in China and Australia by third parties. All material have to be used for its intended purposes only. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials , or for any other materials, products, or services of third-parties 
• All art material supplied by Art Springs are safe. However, please follow manufacturers recommendations and guidelines for safety of yourself and others around you including kids
• Video or online information/tutorials will be offered along with art packs. However, the access will be limited for three months only
• Prices for our products are subject to change without notice.
  We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
  We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service
• Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to change by Art Springs with similar material. Changed material/product will be similar in cost and feel.
• We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.
• We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
• We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected
• We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order

  In no case shall Art Springs, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law
